The leverages for all other instruments are determined at the sole discretion of Paradise Capital, taking into consideration what is deemed reasonable for clients based on risk management.

Indemnification

Arbitration

This arbitration will be conducted in accordance with the Federal Arbitration Act, overseen by a single neutral arbitrator, and administered by the American Arbitration Association or a similar arbitration service chosen by the parties. The location for arbitration will be mutually agreed upon by the parties.

The arbitrator’s award will be conclusive, and judgment may be entered upon it in any court with jurisdiction. Should any legal or equitable action, proceeding, or arbitration arise concerning these Terms and Conditions, the prevailing party is entitled to recover its costs and reasonable attorney fees. The parties commit to arbitrating all disputes and claims related to these terms, whether direct or indirect, including Tort claims resulting from these terms. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The arbitrator will determine the entire dispute, including the scope and enforceability of this arbitration provision. This arbitration provision remains effective even after the termination of these terms. In line with other provisions stated elsewhere, the laws of the State of Wyoming will be applicable to the arbitration proceedings.

Class Action Waiver

Any arbitration conducted under these Terms and Conditions will be conducted on an individual basis; class arbitrations and class/representative/collective actions are not allowed. Both parties agree that a party may only bring claims against the other in an individual capacity and not as a plaintiff or class member in any potential class, collective, and/or representative proceeding. This includes actions in the form of a private attorney general action against the other. Moreover, unless both you and Paradise Capital mutually agree otherwise, the arbitrator is not authorized to consolidate claims from more than one person and cannot preside over any form of a representative or class proceeding.
